Nona Terms of Service

1. Acceptance of the Terms

These Terms of Service (the "Terms") are an agreement between you and SENDA LLC ("we", "us", "our", "Senda"), a limited liability company organized under the laws of the Commonwealth of Puerto Rico, with a mailing address at 410 Avenida Montesol, Ste 14 #2078, Fajardo, Puerto Rico 00738.

By downloading, installing or using the Nona mobile application (the "App") you agree to these Terms. If you do not agree to them, do not use the App.

You must be at least 13 years old to use Nona. If you are between 13 and 18, you represent that a parent or guardian has reviewed and accepted these Terms on your behalf.

2. Important Notices — Please Read Them

Nona is a game. It is not a certified educational tool, nor an authority on sudoku.
You can play without an account. An account is only needed for the social features.
Your account belongs to Juegos Senda, not just to Nona. The same profile, the same @username and the same friends apply across every game in the family. See Section 4.
Your @username is permanent. If you create an account, the @username you choose cannot be changed afterwards, because it is how your friends find you.
The App shows ads. They are what pays for its development.
These Terms include a limitation of liability (Section 9) and an agreement on governing law and venue (Section 13).

3. Description of the Service

Nona offers a different sudoku every day, the same one for everybody, at a difficulty that varies with the day of the week. The App flags mistakes as you make them, keeps count of your points and your streak, and shows a clock that does not affect scoring. It also includes an offline free play mode with unlimited puzzles, which awards neither points nor streak.

The daily sudoku travels inside the App: no connection is needed to play it. For anyone who creates an account, the App adds a profile with an @username, friendships, a friends leaderboard, and invitations to other games in the family.

We may add, change or withdraw features at any time. We work to keep the service available, but we do not guarantee that it will run uninterrupted or error-free.

4. User Account

Playing does not require an account. From the entry screen you can tap "Play without an account" and reach both the daily sudoku and free play.

An account is optional and unlocks the social features: a profile with an @username, friends, the leaderboard and invitations. It is created by signing in with Google or Apple; we neither create nor store passwords.

4.1 One account for the whole family of games

Nona is part of Juegos Senda, a family of games by Senda LLC. Creating your account in Nona creates your Juegos Senda account: if you install another game in the family and sign in with the same Google or Apple credentials, it is the same account. Your @username, display name, avatar, country and friends list are shared across all of them, and changing any of these in one game changes it in the others.

Your progress, by contrast, belongs to each game individually: your Nona points and streak are never mixed with those of any other game.

This has an important consequence when you leave, which is why the App offers two distinct options: leaving Nona only, or deleting your entire Juegos Senda account. See Section 12.

4.2 Your @username

When you create your account you choose a unique and permanent @username, valid across the whole family of games. We reserve the right to reclaim or reassign an @username that impersonates a person or a brand, that is offensive, or that has been registered solely to resell it or to hold it unused.

You are responsible for the activity that takes place in your account. If you believe someone has accessed it without your permission, write to us at support@sendapr.com.

The handling of your data is governed by our Privacy Policy.

5. Ads and Purchases

Nona is free and is funded by advertising through Google AdMob. By using the App you accept that ads will be shown.

We do not control the content of third-party ads and we do not endorse the products or services advertised. Any transaction you enter into with an advertiser is solely between that company and you.

The "Remove ads" purchase

The App offers a single optional purchase: Remove ads, a one-time payment (not a subscription; nothing renews and nothing is charged on a recurring basis) that removes advertising from the App on your device.

The purchase is processed exclusively through Apple's App Store or Google Play; SENDA LLC never sees or stores your payment details.
The price is shown by the store itself before you confirm, and may vary with your country and applicable taxes.
If you reinstall the App or change devices, use "Restore purchases" on the More screen to recover it without paying again (same store account).
Refunds are handled by the store where you bought it, under that store's policies; we cannot issue them directly.
The purchase removes ads but does not alter the game: nobody gains an advantage in play or in the leaderboards by paying.
The purchase is tied to the store account you paid with, not to your Juegos Senda account. Deleting your account does not cancel it, and changing your Apple or Google account does leave you without it.
It is a per-game and per-platform purchase: removing ads in Nona does not remove them in another game in the family, and paying for it on Android does not remove them on iOS.

Right of withdrawal (European Union, EEA and United Kingdom)

If you purchase from the European Union, the EEA or the United Kingdom, consumer law grants you fourteen (14) calendar days to withdraw from a distance contract.

By confirming the "Remove ads" purchase you expressly request that performance begin immediately — the ads disappear at once — and you acknowledge that, once performance is complete, you lose the right of withdrawal, in accordance with Article 16(m) of Directive 2011/83/EU and the national rules transposing it.

This does not affect your statutory rights if the product is defective or does not work as described, nor the refund policies of Apple and Google, who are the ones handling any return (see above).

6. Acceptable Use

In using Nona, you agree not to:

Cheat, automate play, or use bots, external solvers, scripts or modified clients to influence your score or the leaderboard.
Extract the App's puzzle bank, reverse-engineer it, or reach our servers by any means other than the App itself.
Impersonate another person, or choose an @username or display name that misleads others about who you are.
Harass, threaten, or send repeated and unwanted nudges or invitations to another player.
Post content on your profile that is unlawful, hateful, sexually explicit, or that infringes the rights of third parties.
Interfere with the operation of the service or attempt to overload it.
Create multiple accounts in order to manipulate the leaderboard.

You can block any player from their profile, which prevents them from sending you requests, and report conduct that breaks these rules. Reports are reviewed and may lead to suspension of the reported account. A block applies across the whole family of games, not only to Nona.

7. Intellectual Property

The App, its code, its design, its name, its logo and its puzzle bank are the property of Senda LLC and are protected by intellectual property law. You acquire no rights in them beyond the personal, limited, non-exclusive, non-transferable and revocable licence to use the App under these Terms.

The content you contribute — your display name and your @username — remains yours. You grant us a limited licence to display it to other players inside the App, and inside the other Juegos Senda games; which is exactly what the social features do.

Nona is an independent development and is not affiliated with, sponsored by or endorsed by any other sudoku application or publication, nor by Apple, Google or the other companies named in these Terms.

8. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, express or implied. To the extent permitted by law, we expressly disclaim the warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the App will be error-free, that it will be available without interruption, or that your progress data will be kept indefinitely.

9. Limitation of Liability

To the maximum extent permitted by law, Senda LLC will not be liable for indirect, incidental, special, consequential or punitive damages, nor for loss of data, game progress, streaks or points.

Our total, aggregate liability to you for any claim relating to the App will not exceed the total amount you have paid us in the preceding twelve (12) months or US$25, whichever is greater. Since Nona is free, in most cases that amount will be US$25.

Some jurisdictions do not allow certain warranty exclusions or liability limitations; in those cases, the limitations above apply to the maximum extent the law permits.

10. Indemnification

You agree to indemnify and hold harmless Senda LLC, its members and contributors, against any claim, loss or expense (including reasonable attorneys' fees) arising from your use of the App in breach of these Terms or of the law.

11. Changes to the App and to the Terms

11.1 We may modify, suspend or discontinue the App — or any of its features — at any time.

11.2 We may update these Terms. When we do, we will change the "Last updated" date at the top of this document. If the change is significant, we will give notice inside the App. Continuing to use Nona after a change takes effect means that you accept it.

12. Termination

You can stop using Nona whenever you want. The App offers two distinct options, and it is worth not confusing them:

Leave Nona: your Nona progress — streak, points and games — is deleted, and you stop appearing in its leaderboard. You keep your Juegos Senda account, your @username, your avatar, your friends and your progress in the other games.
Delete your Juegos Senda account: everything is deleted, across every game in the family, including those you do not have installed on that phone. It is immediate, irreversible, and it releases your @username for someone else.

We may suspend or terminate your access if you breach these Terms, if your conduct harms other players, or if the law requires us to. Where circumstances allow, we will give you notice beforehand.

Sections 7, 8, 9, 10 and 13 survive termination.

13. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-laws rules. Any dispute will be submitted to the exclusive jurisdiction of the courts of Puerto Rico, and both you and we consent to that jurisdiction.

14. General Provisions

Entire agreement. These Terms and the Privacy Policy constitute the complete agreement between you and Senda LLC regarding the App.
Severability. If a court holds any provision invalid, the rest remains in full force.
No waiver. Our failure to exercise a right at a given moment does not mean we waive it.
Assignment. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition or sale of assets.
App stores. Apple and Google are not parties to these Terms and have no obligation whatsoever to provide support for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
